Privacy Policy
Clinical and medical research are founded upon the collection and analysis of confidential personal information. Individuals will only share their sensitive information where there is a culture of trust and where stakeholders implement safe data handling practices. USPA Concept (“USPA”) recognizes that when we handle sensitive information about any individual, we must do so responsibly, with due care to individual privacy, and comply with the laws regarding data privacy and confidentiality.
This privacy policy describes the main types of personal information we process within our organization, how that information is used and disclosed, and our commitments to the individuals whose information we handle. The Policy explains in general terms how we seek to comply with data privacy laws and regulations, including but not limited to the US Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), state security breach laws in the United States, data protection legislation adopted by other jurisdictions globally, and the privacy and confidentiality requirements of ICH Good Clinical Practice (“GCP”).
USPA has enacted internal policies, procedures, and training programs designed to support compliance with these laws and this policy. Our policies, procedures, and training programs are reviewed on a regular basis.
What Types of Personal Information Does USPA Handle and for What Purposes?
Clinical and Medical Information
As a clinical research organization, USPA conducts clinical trials for pharmaceutical and biotechnology companies. As such, we collect, host, and analyze significant quantities of health data and biomedical samples relating to study subjects. USPA considers itself a co-controller with the sponsor/client in determining how and why clinical and medical data are processed in its capacity as a clinical research organization.
To enhance privacy and consistent with GCP, subjects’ names and other direct identifiers are not attached to records or samples used by USPA’s clients for research purposes.
Clinical Trial Recruitment Information
We collect and maintain personal contact information, details regarding health and medical conditions, and areas of interest in medical research from individuals who have expressed interest in participating in clinical trials. This allows us to match prospective subjects with suitable clinical studies as they arise. We use this information to recruit individuals for clinical trials and to run statistical analyses that support patient recruitment.
Health Screening Information
On some occasions, USPA provides community health screening services for certain conditions or diseases. During these activities, we collect names, contact information, and relevant medical data. With participant consent, this information may be added to our database so that we can contact them for future clinical trial opportunities or additional testing aligned with their medical profile. If participants do not provide such consent, USPA will only share test results directly with the participant’s physician.
Industry Professional Information
In the course of business, USPA interacts with employees, consultants, contractors, and other third parties affiliated with our clients. We record and use the names, contact details, and professional information of these individuals for legitimate business purposes, including project administration, communication, and financial operations. We may also use such information to provide updates or relevant information about USPA’s services.
Employee and Human Resource Data
USPA collects personal information from job applicants, including contact details, qualifications, and employment history, to support hiring decisions. Background checks may be carried out where permitted by law. For employees, we collect information for HR, performance evaluation, payroll, and tax purposes. Similar information may be collected for consultants, contractors, and third parties providing services to USPA.
Web Visitors
USPA collects user-provided information from website visitors when they voluntarily submit it—such as requesting information, inquiring about studies, or applying for positions. Through cookies and similar technologies, USPA may collect data linked to virtual identities for purposes including site analytics and first-party marketing. When visitors share their personal information, these virtual identities may be linked to real-world identities, allowing USPA to tailor communications and content.
Internal and External Disclosures of Personal Information
Personal information may be shared within USPA and its affiliated companies or with third-party agents and service providers on a strict “need to know” basis to support legitimate business purposes. Access to data is restricted. USPA does not sell or trade personal information.
We may disclose personal information where required by law enforcement, judicial authorities, or as part of legal proceedings. We may also disclose information in connection with a merger, acquisition, restructuring, divestiture, reorganization, or sale of assets.
Third-party vendors working with USPA must sign confidentiality or processor agreements requiring them to process personal information solely for contracted purposes and with appropriate safeguards.
Notice and Consent
At the point of data collection, USPA provides clear and conspicuous notice about:
-
How information will be used and disclosed
-
Available choices regarding data handling
-
Applicable informational rights
-
Contact methods for questions or complaints
Notices may be provided in person, by email, phone, mail, or on our website.
USPA may seek consent when required by law or as a matter of best practice. However, in some cases allowed by law—such as low-risk processing or legitimate business interests—we may process information without consent. USPA will also process information without consent when required by law or court order. Consistent with GCP and confidentiality laws, all necessary informed consent for study subjects is obtained on behalf of clients.
Data Quality and Record Retention
Data accuracy is essential to USPA’s operations and the integrity of clinical research. USPA maintains a dedicated Quality Assurance department and ensures that individuals can validate, update, or correct their information.
Personal data is retained according to contractual, legal, and regulatory requirements.
Informational Rights
Where applicable law provides for informational rights, USPA ensures individuals can:
-
Access their data
-
Correct inaccurate information
-
Withdraw consent
-
Object to data processing
-
Request deletion
-
Restrict certain processing activities
-
Opt out of direct marketing
-
Request transmission of their data in a standard digital format
Where law does not mandate these rights, USPA will extend reasonable access, correction, and consent withdrawal options as good practice unless an overriding interest prevails.
Study subjects who wish to exercise rights must contact the investigator at their USPA site.
